A DRIVER caught more than three times the limit told a court it was a ‘moment of madness’.
Damian Kilburn, 38, was at the wheel of his mother's car and was not insured either, Burnley magistrates were told.
Jobless Kilburn had given a test showing 117 micrograms of alcohol in 100 millilitres of breath after being stopped by the police.
The legal limit is 35.
The defendant, of Lock Street, Oswaldtwistle, had admitted driving with excess alcohol on Westgate, Burnley, and no insurance, on October 9.
He has a previous conviction for drink driving.
Kilburn was given a 12 month community order, with supervision and the Drink Impaired Drivers' programme. He was banned for three years.
Andrew Robinson, prosecuting, said police made checks and the car was only registered for one female on the insurance.
An officer spoke to Kilburn, noticed his breath smelled of drink and the defendant gave a positive roadside breath test.
The defendant had been banned for two years for excess alcohol in 2006.
Kilburn said: "I don't know why I did it. It was just stupid.”
