A MOTHER-of-three made her neighbours lives a misery with her loud TV, thumping bass music and constant arguments, magistrates were told.

Nextdoor neighbour Phyliis Brunskill said that since Tracie Ellerton came to live with partner Craig Cryer in Cleveland Street, Colne, there had been noise problems, Reedley magistrates were told.

Ellerton claimed she was not always responsible for the racket, as she often went out drinking until the early hours on Fridays and Saturdays, the court heard.

But she accepted her 16-year-old daughter may have been responsible for playing loud music while she was out.

Police were called out on at least three occasions by Mrs Brunskill, a retired clerical worker, because the noise was wrecking her life and disturbing her sleep.

Howard Culshaw, prosecuting on behalf of Pendle Council, said the noise included television programmes, loud and repetitive bass music and rows between people inside Ellerton's home.

Several reports were made to the authorities, starting just before Christmas last year and continuing on a regular basis until February 20.

Mrs Brunskill kept a log of the disturbances and made frequent reports to East Lancashire's night-time noise nuisance service, based in Blackburn.

An abatement notice was served on Ellerton by the borough council, after initial complaints were made but she breached it on no fewer than 11 occasions.

Ellerton admitted 11 offences of breaching a noise abatement order and was fined £125 with £100 costs and a £15 victim surcharge by magistrates.

She told the court: "I am sorry and I will not let it happen again. Sometimes at the weekend I am not in because I go out.

"I do have a 16-year-old daughter and I know I am responsible for her, but I can't control her if I am not in."

Questioned by magistrates, she said she would often stay out after midnight, or until later weekend closing times of 3am, on Fridays and Saturdays.
