A TEENAGER spotted behind the wheel the same day he was banned from driving, has had a term of detention cut.

Mohammed Zubair, 19, had wanted to go to custody but then wrote to his solicitor saying he didn't like it, Burnley Crown Court heard.

Zubair, disqualified for three years and sent down for four months for driving while disqualified, had preferred a short term of custody.

But four months wasn't as short as the young man would have liked, said his counsel!

Zubair had his detention cut to 14 days and the ban reduced to six months, concurrent with his first ban of 12 months imposed for driving with excess alcohol, by Judge Ian Webster, sitting with two magistrates.

The Judge said the bench felt a large part of the four month term was really for his "contempt" at breaching a court order so quickly.

He added a "proper sentence" would have been 14 days and the disqualification was excessive, as there was no bad driving.

Zubair, of Cliffe Street, Nelson, had appealed against the sentence of Burnley justices.

He had sold the car and stupidly decided to drive it to the buyer.

He made no attempt to drive away and alcohol was not involved.
