RAY Ingleby is considering a dramatic last-ditch legal move to block the planned share issue at Burnley Football Club.

The Turf Moor board expect an imminent indication from Ingleby as to whether he intends to take part in the issues.

But the signs are that Ingleby is unhappy with the promise of just one board seat for a substantial injection of cash.

If the New York-based millionaire was to take up the "two for one" offer on his 25 per cent stake, he would be ploughing £1.4 million into the club.

He believes such a show of faith should be rewarded with at least two board seats.

As it stands, Barry Kilby is set to spend £3 million in acquiring a controlling 59 per cent stake in the club.

Chairman Frank Teasdale will step down as chairman, but remain on the board, if the share issue proceeds as planned.

It is unlikely, though, that Teasdale would want to remain on the board should Ingleby decide to accept the single seat.

Ingleby's team, however, have been examining all their options including their rights under the Companies Act.

Director Clive Holt said a firm answer to the share issue proposal was expected from Ingleby before Christmas.

He said: "We are still awaiting Mr Ingleby's answer. Hopefully it will come in the next few days.

"I would believe it to be on a knife-edge.

"I hope it will be 'Yes, we will come and join you'. Then we can all work together."

Boss Stan Ternent has received no bid from Bury for striker Andy Cooke.

And with the Gigg Lane club in turmoil after last night's resignation of owner Hugh Eaves, no formal approach is expected from Shakers boss Neil Warnock in the near future.

Ternent has expressed an interest in Bury's midfield pair Nicky Daws and Lenny Johnrose and Warnock may simply be playing "tit-for-tat".

Neil Moore and Peter Swan are expected to enjoy more match action for the reserves at Oldham tonight.
