THE sound of breaking glass was followed by the sound of breaking bones when Maurice Derbyshire was tackled by a security guard after smashing a glass door panel at a Clitheroe shop, a court heard.

Blackburn magistrates were told that in the struggle that followed Derbyshire dislocated his left elbow and suffered a broken bone in his left arm.

Derbyshire, 35, of Lawrence Street, Padiham, pleaded guilty to damaging the door at the Spar shop on Garnet Road, Clitheroe. He was given a conditional discharge for 12 months and ordered to pay £189 compensation and £55 costs.

Wendy Shackleton, prosecuting, said Derbyshire went into the shop at 10.05pm and attempted to buy a packet of cigarettes. He had previously been barred from the shop and was asked to leave.

As he left Derbyshire slammed the door with both hands, causing the reinforced glass panel to break. He was detained nearby after a struggle in which he suffered his injuries.

Sarah Perkins, defending, said the offence was one of recklessness rather than intent. She said Derbyshire went to the shop knowing he was barred but hoping they would sell him some cigarettes.

When he was refused he slammed the door in frustration and there then followed the citizen's arrest by the security guard. "He says he did not struggle but was brought to the ground causing a dislocated elbow and a fracture of the elbow," said Miss Perkins. "He has undergone two operations for his injuries."
