A WINDOW cleaner who went to sleep in his car after finding the locks to his house superglued by a business rival - then drove to a supermarket - has been banned from driving for two years.

Burnley magistrates heard how William Francis Cunnie, 47, didn't give a breath test after he was taken to the police station when officers found him in his car, parked in a Tesco car park.

The defendant, of Todmorden Road, Burnley, admitted failing to provide a specimen for analysis on February 22. He was fined £225, with £65 costs.

David Hartley, prosecuting, told the court a Tesco security guard alerted police and when an officer arrived at the store, he smelled drink on the defendant. Cunnie was asked to provide a breath test, refused, was told he would be arrested and then provided a positive sample.

The defendant was then taken to the police station where he failed to give a sample of breath, despite being asked four times.

Trevor Grice, defending, said Cunnie had been to the pub and had had about four or five pints of lager. He had not taken his car but when he got home he found his locks had been superglued. The defendant had complained to police on a couple of occasions over incidents which seemed related to the sale of a window cleaning round.

Cunnie thought he would have to sleep in his car and sat in the vehicle for a considerable period of time until he was woken by the cold shortly before 2am. He then decided to go to Tesco, which was no more than half a mile away, for some cigarettes.
