AN ANGRY hod carrier created a racial rumpus and smashed windows because he claimed he had been short-changed at a newsagents, a court was told.

Lee Gibbons, 20, abused owner Abdul Merchant and then kicked in the windows at the front of the premises after the victim refused to give him more cash.

Gibbons, of Bank Street, Rawtenstall, where the newsagents is situated, admitted using racially-aggravated threats, abusive or insulting words or behaviour, and damage, on April 25.

He was sentenced to a community order, with 12 months supervision, 100 hours unpaid work, and the Think First programme.

He must also pay £500 compensation, and £50 costs.

Sentencing, bench chairman Margaret Dunne told Gibbons that society did not tolerate such offences.

Andrew Creswell, prosecuting, told the court Mr Merchant was working in the shop.

Several customers were on the premises and he served the defendant, who handed over £10.

Gibbons got his change and left the shop.

He returned two minutes later, claimed he had handed over £20 and wanted the rest of his money.

Mr Merchant still had the note Gibbons had given him in his hand and told him he had not given him £20.

Gibbons rolled up his sleeves, making the victim feel threatened, and demanded back his cash.

Mr Merchant refused and was subjected to racial abuse.

Mr Creswell said Gibbons eventually left the store, was again offensive to Mr Merchant and kicked the shop windows, causing them to shatter.

Police were called, Gibbons was arrested and made no comment to questions.

Cathryn Fell, defending, said Gibbons claimed he had been short-changed and was angry.

He admitted using racial language, but claimed the shop owner did the same to him.

He was very sorry, was not racist and apologised.
