A PIPE layer "trying out" a moped the morning after the night before, has paid the price with his second driving ban.
Burnley magistrates heard how Anthony Robinson, 24, had a previous conviction for failing to provide a specimen. He has now lost his licence for three years, after admitting driving with excess alcohol and without insurance and a driving licence.
Robinson, of Shackleton Street, Burnley, was also fined £100.
John Wood, prosecuting, said a breath test showed 42 microgrammes of alcohol in 100 millilitres - the legal limit is 35.
Mark Williams, defending, said Robinson was just trying out the moped in a back street and had not been intending to drive it further.
The defendant had not been drinking that day, but had been out the night before and had a lot of alcohol. He was only just over the limit.
