A 24-YEAR-OLD man who was put on probation for attacking his partner and a schoolboy is now behind bars.

Burnley magistrates heard that David Hoyle was given a two-year order to attend the domestic violence programme but failed to turn up several times and breached the order twice.

He was sent to prison for three months after the bench revoked the order and told him he had failed to respond to any community-based penalty.

Hoyle, of Westgate, Burnley, admitted failing to surrender and breaching probation. He had originally been given the two year order after being convicted of two assaults.

Ruth Powell, prosecuting for the probation service, said that when the defendant breached the order the first time he was told he would go to prison if he did it again.

One of the assaults was on a young person and the probation service had a duty to monitor Hoyle.

Dylan Bradshaw, defending, said Hoyle was on the verge of going to prison. He conceded he had lost touch with the probation service and accepted he had turned his back on the order.

He wanted to complete the probation order and knew the court and the probation service would be concerned about the offences of violence. He did need, and wanted, the help of the probation service.

The defendant now had a fixed address, had completed an application form for a job and was hopeful he would have employment.
