A BREACH of Building Regulations at a house in Nelson could lead to the owner being prosecuted if it is not put right by September 1.

A basement room was constructed at number 21 Lomeshaye Road and after being approached by the council the owner submitted a building regulation application on May 16.

The council's planning manager asked for a report from a structural engineer to confirm that the walls of the house had been adequately supported by 'underpinning' but this report was not produced and the application was rejected in June.

A report was later received from a structural engineer on July 11 and the plans were approved but so far no extra work has been carried out.

Planners have recommended that if the work is not complete by the beginning of next month, the council's Secretary and Solicitor should be authorised to prosecute the owner and the builder and serve a notice on the owner to remove or alter the building work already carried out.
