A FATHER-OF-TWO almost three times the drink-drive limit has to wait until tomorrow to learn of his fate.

Delivery driver Mark Smith, 32, claimed his drink had been spiked as he had only had two-and-a-half pints. He told police he was not fit to drive and had wanted to be arrested, Burnley Magistrates were told.

Smith, of Fennyfold Terrace, Padiham, admitted driving with excess alcohol and possessing cannabis resin.

His case was adjourned until Wednesday morning and the bench said they were looking at a community punishment order. He was given an interim ban.

Mercedah Jabbari, prosecuting, told the court that police went to reports of a road smash on Manchester Road, Burnley.

The defendant had hit the back of a Land Rover which had broken down.

Smith smelled of drink and was unsteady on his feet. He gave police his car keys and said he had drunk a lager before the accident.

Smith, who was found to have cannabis on him, told officers: "I am sorry. I am not fit to drive. I wanted to be arrested."

The lower of two breath tests showed 91 microgrammes of alcohol in 100 mililitres of breath - the legal limit is 35. The court heard he was of previous good character.

Nigel Holden, defending, said Smith was convinced his drink was spiked. He claimed he had two and a half pints. That amount might have taken him over

the legal limit, but it would not take him to a reading of 91.

Smith was a delivery driver so a ban would have consequences over and above the penalties imposed in court.

Mr Holden added the defendant stayed at the scene of the accident until police arrived and co-operated with the officers.
