A PERVERT jailed for molesting a disabled teenager has failed in an Appeal Court bid to cut his five-year jail sentence.

Terence Minshull (53), of Chapelfield, Radcliffe, was imprisoned for five years at Warrington Crown Court in September after he pleaded guilty to assault by penetration a new offence created this year.

Lord Justice Rose, sitting with Mr Justice Henriques and Mrs Justice Dobbs at London's Appeal Court, refused to reduce Minshull's jail term, and dismissed arguments it was 'manifestly excessive'.

The judge said Minshull pounced on the "vulnerable" girl, aged in her early teens and who had severe learning disabilities, when she went to the toilet.

He followed the girl to the bathroom, and walked into the room as she was leaving.

He grabbed her, pulled down her underwear and made her stand facing away from him while he held onto her wrists.

He then subjected her to a sickening assault, ignoring the terrified teenager's pleas for him to stop.

A witness then walked in on Minshull and police were immediately summoned to the scene.

He initially denied the assault when interviewed by police, but later admitted it when confronted by DNA evidence.

Lawyers on Minshulls behalf argued the five-year jail term was 'manifestly excessive' in view of his guilty plea.

But, dismissing the appeal, Lord Justice Rose said the Crown Court judge's sentence was 'not only not too high, it was correct'.

He added: 'The sentence of five years was unimpeachable, and this application must be dismissed.'
