BURY magistrates handed out a conditional discharge to a motorist who had driven a car in Whitefield whilst over the legal alcohol limit.
However the bench had heard that Mansar Hussain had just been sent by Bolton Crown Court to three and a half years in jail for drug dealing.
Hussain, of Central Avenue, Bury, admitted the offence of drink-driving in Manchester Road, Whitefield, but their options were limited because of the outcome of the crown court case, and magistrates imposed a conditional discharge for 12 months and a nominal 12-month driving ban.
The 33-year-old defendant was brought from HMP Forest Bank on a Home Office Production Order to attend the Bury court.
Miss Enza Chiappi, prosecuting, said a police officer stopped Hussain in Manchester Road because he was not wearing a seat belt.
When he spoke to Hussain the officer smelled alcohol on his breath. He was taken to the police station and tested and found to have 45 microgrammes of alcohol in 100 millilitres of breath, compared with the legal limit of 35mg in 100ml. Hussain made no reply when charged.
