A MAN with no previous criminal record who stole food and drink from Tesco's store in Bury claimed in court that he had no recollection of the event.

However Gabriel Byrne admitted that he had been drinking and that he suffered blackouts.

Byrne (45), of Regent Street, Bury, was before the town's magistrates where he pleaded guilty to a charge of stealing goods worth £7 belonging to Tesco at Woodfield retail park.

Mr Mike Wallbank, prosecuting, said it was clear to staff at the store that Byrne had been drinking and he was seen to select the goods and leave the premises without paying. He was accordingly detained.

Byrne said: "I'd been drinking and I suffer blackouts. I've no recollection of this. I've never done it before."

The court heard that Byrne had no previous record.

He was fined £50 and ordered to pay £45 court costs.
