Search the Public Notice PortalDevelopers behind a major housing estate in Poulton-le-Fylde have applied to remove a planning condition linked to a package of road improvement works, arguing that some of the schemes have not been delivered despite money being paid towards them.
Persimmon Homes Lancashire and Jones Homes have submitted an application to Wyre Council seeking the removal of Condition 15 attached to planning permission for a development of 516 homes on land at Garstang Road East.
The scheme was approved in 2017 and includes 30 per cent affordable housing, landscaping, two new access points and footpaths.
Condition 15 required a series of highway improvements to be carried out alongside the development, including junction upgrades, new crossings, traffic signal improvements and road markings at locations around Poulton.
In a supporting statement submitted with the application, the developers say a number of the required works have already been completed, while others are no longer considered necessary by the local planning and highway authorities.
According to the document, schemes involving improvements at the site access points, the Moorland Road and Garstang Road East junction, and Moorland Road and Little Poulton Lane have been delivered.
The statement also says planned works at Skippool Roundabout and a proposed pedestrian crossing on Hardhorn Road are no longer required following discussions with authorities.
However, the developers say three remaining schemes have not been completed.
These include upgrades to the Lower Green and Garstang Road East junction, improvements at the Hardhorn Road and Garstang Road East junction, and works at Moorland Road and Breck Road.
The supporting statement claims Lancashire County Council was paid £73,905.22 in June 2022 to undertake the works required for those schemes.
It says the 516-home development is now nearing completion but that "no progress" has been made on the projects, despite repeated requests from the applicant for updates.
The document states: "It can be reasonably assumed that the LHA no longer requires schemes 3-5 to be implemented."

Developers are therefore asking for Condition 15 to be removed in its entirety, arguing that the only highway works deemed necessary since planning permission was granted have already been completed.
As an alternative, the applicants have proposed a deed of variation to the site's Section 106 agreement if Lancashire County Council considers the remaining works are still needed.
Under that arrangement, the £73,905.22 contribution paid in 2022 would be returned to the developers if it remains unspent by June 22, 2027.
The application will be considered by Wyre Council in due course.
