The owners of an Oswaldtwistle farm have asked Hyndburn Council to confirm the legal status of a building in its grounds called ‘The Old Pig House’.

Andrew and Jean Sharples have asked for a Certificate of Lawful Use for the continued residential use of the property at Rushes Farm in the township’s Stanhill Lane.

A supporting statement submitted with the application says: “This Certificate of Lawfulness application (existing use) relates to the creation of a dwelling at Rushes Farm.

"The dwelling was created from an existing building, and is known as The Old Pig House.

“The building work for the creation of the dwelling was completed before April 25, 2024, and has been substantially completed for more than four years.

“Andrew and Jean Sharples are the owners of Rushes Farm. They acquired the farm in June 2001.

“Andrew and Jean Sharples live in residential accommodation within the converted barn at the farm, and have done so since 2017.

“In May 2017, Andrew Sharples commenced work to convert the former piggery building at the farm to residential accommodation for his daughter.

"The conversion work was undertaken by Andrew Sharples and his son, Andrew Richard Sharples.

“The conversion was completed in June 2017, with the dwelling then referred to as The Old Pig House.

"Andrew and Jean Sharples’ daughter, Katy Elizabeth Johnson, was the original occupier of The Old Pig House. She occupied the dwelling from June 2017 to December 2020.

“Katy Johnson lived in the dwelling, as her sole residence, with her baby son (born April 2017), and initially with her husband, although he subsequently left.

“The dwelling was extended in September 2020 to provide a bedroom.

“The extension work was completed in December 2020.

“Katy Johnson moved out of The Old Pig House in December 2020, moving into the farmhouse at Rushes Farm.

“From December 2020, the Old Pig House was occupied by Jean Sharples’ sister, Anne McNamee, and her husband, John. John McNamee had terminal cancer and died in February 2021.

“Anne McNamee continues to live in The Old Pig House.

“The services for The Old Pig House are shared with the other dwellings at the farm, which include water, electricity and foul drainage.

“The dwelling, The Old Pig House, was completed before April 25 2024, and has been substantially completed for more than four years at the date of submission of the Certificate of Lawfulness application.

“The dwelling is therefore immune from enforcement action and a Certificate of Lawfulness should be granted.”
