A "poor choice" to overtake another vehicle proved costly for a Darwen man.

Blackburn Magistrates' Court heard the manoeuvre at over 60mph led to a head-on collision with a car travelling in the opposite direction.

Lee Clemson, 33, of Back Duckworth Street, Darwen, pleaded guilty to driving without due care and attention.

He was fined £1,350, ordered to pay a £540 victim surcharge and £325 costs, and his licence was endorsed with nine penalty points.

Kate Moore, prosecuting, said an eyewitness account of the incident came from a passenger in a third car.

She was travelling along Marsh House Lane towards Darwen and near the junction with Pole Lane when she saw a blue car coming in the opposite direction, travelling at a normal speed.

She said all of a sudden, a white BMW overtook them, doing an estimated 60mph and hit the blue car head-on.

Both cars spun around before coming to a stop. Police reported that both vehicles were extensively damaged.

Bilal Rasool, mitigating, said his client had been on his way to visit his mother.

He said he had no recollection of the incident or what happened after.

"He accepts he made a poor decision to overtake at the wrong time," said Mr Rasool.
