Search the Public Notice PortalThe developer of nine new homes on an 'unsightly and unkempt' piece of land on the outskirts of Blackburn town centre has been given permission to install an electric sliding gate despite fears that children could get trapped in it.
In November 2022, the Geloo brothers of Cleaver Street had their plan for eight semi-detached dormer homes and one detached house on a brownfield site in Queens Park approved by Blackburn with Darwen Council.
Now, a related proposal for a gate on the entrance to the mini-estate in Lambeth Street and next to Parkside Mill has also been granted permission, subject to a condition that the pedestrian access is kept open and unlocked at all times.
A planning officer's report says: "The application site relates to a new residential development granted planning permission in November 2022.
"The site is under construction for the erection of nine dwellings.
"The site is positioned on a side road that branches from Lambeth Street and links to Ripon Street and Lincoln Road.
"This application seeks planning permission for the installation of a 1.5 metre high electric sliding gate and pedestrian access gate.
"The sliding gate will provide access, including vehicle access for users and occupants of the dwellings, and the single-entry access gate will provide pedestrian access to and from Lincoln Road and Lambeth Street.
"Highways have offered objections.
"Automatic gates present a number of risks, including being hit by a moving gate, being caught, dragged, or cut on the moving parts.
"Past cases of incidents/reports of children getting trapped and caught between gates – advise against this form of gate and to seek an alternative.
"The pedestrian/cycleway connections through to Lincoln Road should not be hindered in any way and should be accessible at all times, therefore the pedestrian access is not supported.
"The proposal seeks the installation of a 1.5m high sliding and pedestrian gate supported by 1.5m high brick columns to either side.
"Concerns have been raised by highways colleagues.
"Whilst the content of these comments are noted, it should be noted that when considering applications, due consideration must be given to the ‘fall-back’ position.
"In this instance, the installation of a one metre high sliding and access gate as proposed would not require planning permission.
"With regards to concerns raised regarding a pedestrian gate, a condition will be applied for the gate to remain unlocked at all times.
"The security and safeguarding benefits of the proposed sliding gate weigh heavily in its favour."
