BOSSES are preparing to force entry to a house believed to be the source of a long-running leaky pipe.

The move could end months of misery for residents affected by the "dangerous" stream of water running down their road. And the council is to ask United Utilities to foot the bill although taxpayers may still pay for road repairs.

Since last October, water has run down James Street West near Darwen Health Centre from a pipe in nearby Reservoir Street. United Utilities said its workers were refused entry into the house where they believe the leak originated from a broken, privately-owned pipe.

But now it has been revealed the firm has told its lawyers to apply for a warrant to get into the house. The saga was raised by Sunnyhurst councillor Dave Hollings at a recent meeting of Blackburn with Darwen Council's ruling executive board, which said the water was a safety hazard.

He said: "The water has now severely eroded the road surface. This is making a busy stretch of road uncomfortable and dangerous."

Executive member for regeneration Alan Cottam said: "The information from United Utilities is that there has been more than one leak on a common supply pipe which feeds the properties on Reservoir Street. While most leaks have now been repaired there is one homeowner who is refusing to have it repaired or even allow United Utilities access to his property.

"This issue is currently with United Utilities' legal section which will be applying to court for a warrant to enter the property to fix the leak."

Council officers will work with the firm to help it gain access to the house, said Coun Cottam.
