Two brothers kicked and punched a man around 18 times to the face, body and head over a family disagreement.

Ibran and Shahzad Khan denied their involvement in the incident, which took place just off Blackburn Road in Accrington in March 2020, and took the matter to trial.

It was only when new CCTV evidence came to light, showing the brothers raining blows to their victim’s head did they change their pleas to assault occasioning actual bodily harm to guilty.

Following further delay due to the bar strike, the case came for sentencing on Tuesday, January 17, almost three years after the incident occurred.

Preston Crown Court was told the Khans and their victim were known to each other and were related through marriage.

There had been some kind of disagreement within the family unit, and on March 10 2020, the victim had been walking down Blackburn Road towards a car accessory shop at around 1.45pm, when he was approached and chased by Ibran Khan.

CCTV footage played in court showed the brothers chasing their victim before he is tripped up by Ibran Khan, and they launch into a frenzied attack- kicking him, punching him, and lashing out at him, even while he is on the floor.

At one point, one of the brothers holds the man down so the other can continue landing blows to his face.

As a result, the victim needed his lip gluing and suffered black eyes, facial bruising and fractures.

Neither of the defendants were arrested but both voluntarily attended Greenbank Police Station a while later, but provided no comment in their interviews.

Judge Andrew Jefferies said: “You weren’t just kicking your victim, but kicking him to the head, which is clear for me to see.

“As a result of the incident your victim was left needing his lip glued, bruising, with cuts to his tongue, lip and head.

“At one point the victim can be seen to sprawl on the floor. You would think that might be the end of the incident but it’s not.

“It was only on the day of the trial that fresh CCTV evidence was available so both of you pleaded guilty.

“In both of your cases it’s clear there’s no remorse or regret – regret maybe for your own positions but no remorse as you went a year maintaining your not guilty pleas.”

Ibran Khan, 32, of Spring Meadow, Clayton-le-Moors, and Shahzad Khan, 26, of Tremellen Street, Accrington, were each sentenced to 16 months in prison.

They were also made subject to a restraining order against their victim.
