TWO brothers became aggressive when police who had stopped them said they were going to carry out a drug search.

Blackburn magistrates heard a third brother joined them as police were already struggling to control the situation which had attracted a hostile crowd.

More officers arrived on the scene and the siblings were eventually arrested.

Naim Khan, 30, Samwad Khan, 33, and Wasim Khan, 29, all of Lee Street, Burnley, pleaded guilty to using threatening behaviour. They were all made subject to a community order for 12 months with 60 hours unpaid work and ordered to pay £50 compensation, £85 costs and £114 victim surcharge. Wasim Khan was also ordered to complete 15 days Rehabilitation Activity Requirement.

Paul Sumner, prosecuting, said an officer stopped a car because of the manner in which it was being drive. The driver and passenger were initially "extremely friendly and helpful".

She did a computer check on the vehicle which came back with a drugs marker.

"When she said she was carrying out a drug search Samwad became very abrupt and non-compliant," said Mr Sumner. "Wasim got out of the vehicle and started to shout that he wasn't staying."

He said Wasim's behaviour was starting to escalate and he was trying to pull away from the officer and actively resist. Samwad was shouting and trying to pull his brother away.

"A crowd of men had gathered and they were getting closer and shouting at the officers to get off him," said Mr Sumner. "Other officers arrived and at some stage Naim was seen running at officers and screaming at them to get off Wasim."

More officers arrived and the trio were eventually overpowered and arrested.

Jonathan Taylor, defending Naim, said he had arrived on the scene late but accepted he didn't assist in calming things down.

"All three of them did things they regret and they accept they should have shown more restraint," said Mr Taylor. "They have more than learnt their lesson from this incident."

He said hopefully none of them would be before the court again.

"They all want me to make it clear they will not be involved in anything like this in the future," said Mr Taylor.
