A LATE-night disturbance ended with a man throwing a stone through his neighbour’s window.

Blackburn magistrates heard Lee Robert Hepple, who threw the stone, suffered some rough justice when the victim’s son arrived ahead of the police.

Hepple, 33, of Devonport Court, Blackburn, pleaded guilty to criminal damage to a window.

He was given a conditional discharge for six months and ordered to pay £250 compensation.

Peter Williams, prosecuting, said there was a late-night disturbance on Devonport Court and the victim shouted out of her first-floor window at a male to go away.

“He threw a mobile phone at the window and when she said she was calling the police he threw a brick through it,” said Mr Williams.

“Her son then attended and there was an incident between them.”

Jonathan Taylor, defending, said his client had heard the disturbance and went out to investigate.

“He says the neighbour above shouted at him and he shouted back that he had just come out,” said Mr Taylor.

“She said she was going to phone the police and he said she could use his phone and threw it up.”

Mr Taylor said his client was surprised when the phone went in through the open window and into the room.

“She said he wasn’t getting it back, they started arguing and, ultimately, he threw a stone at the window, causing it to smash.”

Mr Taylor said the woman’s son then turned up and some summary justice was dispensed.

“He was kicked, knocked to the floor and beaten up,” said Mr Taylor.

“He complained to the police that he had been assaulted but they were not interested.”
