A SERVING soldier hurled racial abuse at the owners of a Chester takeaway before wiping his bare bottom on the counter.

Richard Robinson, 23, of Brassey Street, Burnley, pleaded guilty to charges of racially aggravated distress, criminal damage and threatening behaviour when he appeared at Chester Magistrates Court on Tuesday, March 15.

Prosecuting, Jonathan Wilkinson said it was at 1.40am on November 10 when Robinson was at the Upper Crust Pizzeria on Foregate Street and was said to be "play fighting" with another man, which led to a door handle being damaged at £20 cost.

Both men were told to stop their behaviour, but Robinson began to verbally abuse staff there.

He shouted to them: "I will wipe my ass on your counter."

He then turned to one staff member and said: "You need to be quiet you foreign ****, you are a foreign b*****d," before also verbally abusing the staff member's wife.

Mr Wilkinson said: "He [Robinson] then pulls down his trousers and wipes his behind on the takeaway counter."

The court heard CCTV footage was available of the incident, but Mr Wilkinson said: "I don't imagine anyone will want to see that."

Robinson had one previous conviction for battery from 2015.

A restraining order was sought for Robinson to be prevented from entering The Upper Crust Pizzeria.

Defending, Michael Gray said a guilty plea had been entered at the earliest opportunity to all charges.

Robinson was a serving soldier and was currently based at the Dale Barracks, with a lieutenant at the back of court ready to report the outcome of the case to Robinson's superiors.

The battery conviction had taken place when Robinson was still a juvenile.

Robinson was due to come out of the Army in the next month to be home with his family.

The defendant remembered "very little" of the incident as he was "very drunk", and expressed remorse for his behaviour.

Magistrates adjourned the case for a pre-sentence report to be obtained.

Robinson was handed unconditional bail and will be sentenced next month at Chester Magistrates Court. No restraining order was imposed at this stage.
