A MAN was caught on CCTV trying to use a bank card that didn't belong to him.

Blackburn magistrates heard the card belonged to an elderly gentleman who lived in a care home and he had no idea how the card had gone from his possession.

Zohaib Ijaz, 21, of Nuttall Street, Blackburn, pleaded guilty to fraud by false representation. He was fined £40 and ordered to pay £85 costs and £34 victim surcharge.

Graham Tindall, prosecuting, said the card owner had received a text message saying his card was being used fraudulently at a petrol station in Accrington.

"He had no idea the card had been misplaced," said Mr Tindall.

Richard Prew, defending, said it had been an opportunist, one-off offence with no planning.

"He found the card and tried to use it to buy some cigarettes," said Mr Prew.

"The transaction was declined and he was caught on CCTV and that is the top and bottom of it."
