A DRIVER whose car flipped onto its roof after colliding with a parked van was over the drink-drive limit.

Blackburn magistrates heard Sheher Noor was trapped, upside down in his car and was aggressive towards a witness who went to see if he was alright.

He was also abusive towards the police when they arrived on the scene of the accident in Stanhill Lane, Oswaldtwistle.

Noor, 26, of Wycollar Avenue, Burnley, pleaded guilty to driving with excess alcohol. He was made subject to a community order for six months with 15 days rehabilitation activity requirement, banned from driving for 19 months, fined £200 and ordered to pay £95 victim surcharge and £85 costs.

Katie Lord, prosecuting, said a witness was walking along Stanhill Lane with his partner and had just passed a parked van when he saw a red car travelling towards them at excessive speed.

"The car collided with the van and went airborne before landing on its roof," said Miss Lord. "There were two passengers in the car and when the witness went over to check on the driver he saw two empty vodka bottles in the car and could smell alcohol on the driver's breath. The driver was being aggressive towards him."

Jonathan Taylor, defending, said his client apologised for what had happened.

"He had been working and accepts he had a drink with a friend," said Mr Taylor. "Because of the time that had elapsed he didn't think he would still be over the limit."

Mr Taylor said his client suffered concussion as a result of the crash and had little recollection of what happened.

"He was disorientated, he was upside down, and he apologises for any language he used," said Mr Taylor.

"He doesn't recall that at all."
