A WOMAN who had been planning the return to business of the family travelling show was breathalysed as she drove home.

Blackburn magistrates heard Kimberley Cubbins attracted the attention of the police because she was only doing 40mph on the motorway and was struggling to maintain lane discipline.

Cubbins, 41, of Canal Way, Altham, pleaded guilty to driving with excess alcohol. She was banned for 12 moths, fined £400 and ordered to pay £85 costs and £40 victim surcharge.

Joseph Broadsmith, prosecuting, the attention of police was drawn to a pickup truck on the motorway doing about 40 mph. Cubbins failed a roadside breath test and at the police station gave a breathalyser reading of 52 against the legal limit of 35.

Gareth Price, defending, said his client was a lady of previous good character who had held a driving licence since she was 18 years of age.

"She has also obtained class 1 and class 2 HGV licences," said Mr Price.

"This is particularly disappointing because there are going to be significant consequences for her and the business she is involved in."

Mr Price said that with her family the defendant had been involved in the show industry and travelled up and down the country setting up shows and fairgrounds.

"They are getting ready to open up again next week and the loss of her licence is going to cause significant problems," said Mr Price.

He said she had drunk a couple of glasses of wine with a meal with her boyfriend and was only driving slowly on her way home because she felt there was a problem with the vehicle and didn't want anything to go wrong at high speed.
