POLICE were alerted to a possible drink-driver at a McDonald's drive-thru at 6.45am.

Blackburn magistrates heard when officers confronted Shafaq Hussain on the car park of the Accrington restaurant his car rolled back and hit their vehicle.

"Such was his level of intoxification he had forgotten to put his handbrake on," said Rachel Dixon, prosecuting.

Hussain, 41, of Steiner Street, Accrington, was convicted in his absence of failing to provide a specimen for analysis. He was made subject to a community order for 12 months with 100 hours unpaid work, banned from driving for three years and ordered to pay £85 costs and £95 victim surcharge.

Miss Dixon said Hussain stumbled out of his car and was struggling to stand up. He refused to co-operate with a roadside breath test and did not give any reason for failing to provide at the police station.

"There was clearly a high level of impairment," said Miss Dixon. She said he had three previous alcohol related driving convictions.

Richard Prew, defending, said his client had tried to provide a sample at the police station but had failed on four occasions to complete the process.

He said Hussain had been drinking brandy the night before and had stopped at McDonald's on his way to work to get some breakfast.
