A MAN who was banned by a restraining order from having any contact with his former partner was found in bed with her.

Blackburn magistrates heard she remonstrated with the officers and asked them not to arrest Kelvin Ashley Parkinson.

Parkinson, 32, of Dunoon Drive, Blackburn, pleaded guilty to breach of a restraining order. He was sentenced to 12 weeks in prison suspended for 12 months and ordered to pay £128 victim surcharge and £85 costs.

Sazeeda Ismail, prosecuting, said officers attended at an address on Richmond Place, Accrington, after receiving information that Parkinson was there with his former partner.

"They were in bed together when the police attended," said Miss Ismail.

Neil Howard, defending, said the facts were accepted.

"When the police arrived they were together and suffice to say it was not her who complained," said Mr Howard.

"She clearly consented to be with him and she remonstrated with the officers not to arrest him. She will have to approach the courts if she wants the order removed."
