A MAN involved in a noisy, late night dispute resisted violently when police tried to arrest him.

Blackburn magistrates heard Jordan Batty spat at police officers and tried to bite them as they tried to put him in a secure van.

And he had to be pepper sprayed and put in handcuffs and limb restraints before the officers could detain him.

Batty, 20, of Barnes Street, Accrington, pleaded guilty to using threatening behaviour, assaulting a police officer and two charges of obstructing a police officers. He was made subject to a curfew for 20 weeks between 7pm and 7am and ordered to pay £200 compensation to PC Martin Lafranceschina.

Scott Parker, prosecuting, said police attended reports of two men and a female involved in a loud dispute on Barnes Street. Batty was shouting and swearing. The officer tried to engage with him but Batty kept walking away.

"He saw he was smoking a cannabis cigarette and told him to throw it away because that was an offence," said Mr Parker.

"When he told him he was being arrested for a public order offence and took hold of him he became resistant and tried to pull away."

Mr Parker said PC Lafranceschina struggled to control Batty who kicked out as he took him to the floor. Two other officers came to his assistance and despite being pepper sprayed Batty continued to struggle.

"They managed to apply handcuffs to the rear and he started spitting at the officers and tried to bite two of them," said Mr Parker.

"They couldn't get him into the back of the van and put him on the floor again while leg restraints were applied."

Mr Parker said PC Lafranceschina suffered a dislocated finger during the struggle.

Jonathan Taylor, defending, said his client was deeply remorseful and accepted responsibility for his actions.

"He knows alcohol is no excuse for the way he behaved," said Mr Taylor.

"He was close to his own home and he just wanted to get away from the situation. When the police took hold of him things deteriorated very quickly.

"He accepts that if he had stood still he would have been arrested and put in the back of the van and that would have been it."
