A WOMAN who was going through a marital break down got in her car to drive away from an argument.

Blackburn magistrates heard Rebecca Halliwell, who attracted the attention of the police because she was driving slowly, subsequently failed a breathalyser.

Halliwell, 37, of Orpington Square, Burnley, pleaded guilty to driving with excess alcohol. She was fined £120 with £85 costs and £34 victim surcharge and banned from driving for 18 months. The court heard she gave a reading of 71 against the legal limit of 35.

David Lawson, defending, said his client had no previous convictions and was thoroughly ashamed and embarrassed to be appearing in court for the first time.

The offence was committed against the background of a marital break-up," said Mr Lawson.

"There was an argument and she went for a drive to clear her head, not thinking she would be over the limit."
