A DRIVER is celebrating a ‘victory for common sense’ after having a parking ticket overturned.

Anthony Rishton, 45, received the two fines when he parked his Mazda on Vicar Street, in Blackburn to get to his work.

The first Penalty Charge Notice (PCN) was issued at 11.39am on September 25 and then Mr Rishton was shocked to receive another at 11.20am on September 27.

But he says his second parking ticket has been thrown out now following a tribunal on Thursday.

Mr Rishton, from Earby, said: "It’s great news and a victory for common sense.”

He said a solicitor from an independent parking tribunal told him pictures taken by a council traffic warden were inconclusive and didn’t back up his notes.

He is now planning on appealing the first parking ticket.

Martin Eden, director of environment and operations at Blackburn with Darwen Council, said: "While we respect the decision of the TPT, we were surprised at the result of the tribunal, but I am pleased that the adjudicator made it clear that they did not find that there has been any disproportionate enforcement or victimisation by the council against Mr Rishton.

"We do believe that the evidence submitted clearly shows that a parking contravention has occurred and we are currently entering the process to appeal this decision.”
