A motorist who thought he was the victim of another man's poor driving failed a breathalyser.
Blackburn magistrates heard Adam James Forshaw had been out for a meal and didn't think he would be over the limit.
Forshaw, 27, of Watson Street, Oswaldtwistle, pleaded guilty to driving with excess alcohol.
He was fined £350 with £85 costs and £35 victim surcharge and banned from driving for 18 months. He gave a reading of 67 against the legal limit of 35.
Jonathan Taylor, defending, said as he was driving round a corner on his way home a car came the other way on the wrong side of the road and there was a collision.
"That is being sorted out by the insurance companies but his mistake was thinking that because he had eaten and it had been over a long period of time he would be under the limit," said Mr Taylor.
