STAFF at Burger King in Blackburn called the police because they were concerned a drive-thru customer had been drinking.
Blackburn magistrates heard when he was stopped Liam Conan Vickerstaff had a five year old girl in his car.
Vickerstaff, 28, of Park Street, Great Harwood, pleaded guilty to driving with excess alcohol.
He was banned from driving for 14 months, fined £300 and ordered to pay £85 costs and £30 victim surcharge.
Jonathan Taylor, defending, said Vickerstaff had been to the cinema and then the bowling alley where he had three cans of lager.
"He didn't feel he was over the limit but has to accept that he was," said Mr Taylor.
