A MAN who had drunk “10 plus pints” racially abused and spat at officers who went to arrest him for being drunk and disorderly.

Blackburn magistrates heard Lance Luke Henry, 31, of Exchange Street, Accrington spat at one of the officers who was now having to undergo precautionary tests and treatment which would last for six months.

Henry pleaded guilty to racially aggravated on PCs Patel and Khan.

Tracy Yates, prosecuting, said Henry spat towards both officers but only connected with one and shouted derogatory comments both referring to their colour. She said: “The officers felt they had dealt with him with respect at all times.”

Richard Prew, defending, said his client had been out of trouble for 10 years prior to the incident“The situation arose out of an incident involving him and his former partner. He suffered a bite mark on his leg but when police arrived they treated her as the victim and not him. He was arrested and he felt extremely aggrieved about that.”

Mr Prew said Henry accepted that his behaviour had been unacceptable and wished to apologise to both officers. Henry was made subject to a community order for 12 months with 20 days rehabilitation activity requirement and 200 hours unpaid work. He was ordered to pay £200 to PC Patel and £100 to PC Khan, £85 costs and £85 victim surcharge
