A MAN who put up a struggle with police after they were called to a domestic row was fined £180 by Burnley magistrates.

The court was told how Alan Morton, 46, was seen holding a weapon and was drunk.

Morton, of Elmwood Street, Burnley, admitted two charges of resisting police, last December 19.

He had been subject to a suspended jail term at the time and although the bench did not activate it, they extended the operational period to two years.

Carl Gaffney, prose-cuting, told the court police were called to Pritchard Street, Burnley, where the defendant was living at the time. A distressed woman's voice was heard.

Officers shouted through the letter box for somebody to open the door and could see Morton holding a weapon.

Mr Gaffney said police kicked the door in and found Amy Morton, the defendant's partner.

She was hysterical and upset.

At that point the defendant was not holding any weapon.

An officer approached Morton with his incapacitant spray and told him he was under arrest.

Graeme Tindall, defen-ding, said Morton had had quite significant mental health problems.

He had complied with the suspended sentence order and had not been in trouble since the offences.
