Now this opens up a whole discussion on insurance payouts. It has long been the case that, if a person in a car is injured, their payout may be reduced by 25 per cent if they were not wearing a seat belt because they have contributed to their own injury.

In terms of damage caused to a parked vehicle, the driver of the moving vehicle is liable 100 per cent regardless of how badly or illegally parked the stationary vehicle is. All of the motorists who follow the rules and park sensibly and are prepared to walk a few yards will know that those who break the rules appear to have no sanctions. One way to help bad drivers in choosing their parking place would be if it costs them some money when their car is damaged.

I don’t know if Mr Sargeson is entitled to use the disabled bay (he may wish to tell us) but I have observed many people breaking these rules are likely to consider other rules don’t apply to them either. Until they become the victim.
