Rawtenstall takeaway boss fined for wrong shutters

AN ongoing battle over security shutters has left a Rawtenstall takeaway boss with a £350 legal bill.

Hassan Waqar Malik, owner of Freddy’s Chicken and Pizza, in Bury Road, claims his shop is plagued by vandals after the pubs empty.

But security shutters installed at the premises have fallen foul of Rossendale Council’s planning department.

Shopkeepers across the Valley have been in conflict with the council over the shutters issue amid claims planning policies may be about to change.

Reedley magistrates heard that Malik was repeatedly warned about the shutters throughout 2010 and 2011.

Council officials also warned him about displaying an illuminated sign at the premises, without applying for planning permission.

Malik, 26, of Pringle Street, Blackburn, appeared before magistrates and admitted breaching a planning condition notice.

Ben Leech, defending, said his client believed he had ordered grill-style security shutters, which were acceptable to the authority.

And he could see that other shops along the same parade were allowed various forms of shutters, the court heard.

The shutters had not been down since the council complained - even though his window had been smashed and Malik had been left with a £350 repair bill.

And if the illuminated sign was taken away then the takeaway owner was at risk of losing his Freddy’s franchise, added Mr Leech.

Magistrates chairman David Bennett said Malik would be fined £150 with £200 costs, as he already has debts owing to the court.

Malik was fined £525 last year by the courts for failing to provide a disabled access to the shop.

Speaking after the case, his brother Waqqas Malik, co-owner, said: “It is absolutely ridiculous that I have been fined for trying to protect my property. Especially as other shops in the area have shutters too and they are not being fined.”

Mr Maliq is not comparing like with like the other shops had their shutters in place before the planning regulations were introduced.
.
Perhaps they would have been better off finding out what the planning regulations were before they applied for the franchise.

Perhaps Rossendale council would prefer to see another empty business with boarded up windows? Its hard enough for businesses to survive in Rawtenstall as it is without this kind of nonsense intervention.

This man and the other coplainers know the rules. If they can't abide with them like rest of us they should move on. How come he still has debts owing to the court.

I always dispair at the 'rules are rules' attitude of some people who are too scared to stand up to authority.

Do the council take asthetics over security these days? It also sounds like they have a vendetta against this chap. Who fines a takeaway for not providing disabled access?

Jobsworths seem to like putting small business people out of work. It must make them feel powerful.

Business people provide a contribution to society whereas jobsworths are just a drain
