Former Rossendale landlord jailed after failing to pay smoking ban fines


A LANDLORD who ran pubs in East Lancashire has been jailed after refusing to pay fines imposed when he defied the smoking ban.

Nick Hogan, former landlord of the Holden Arms in Haslingden and the Waterside pub in Summerseat, near Ramsbottom, was fined £3,000 and ordered to pay £7,136 in costs when he was found guilty of breaching the ban in January, 2008.

At the time of the breach he was in charge of The Swan and Barristers in Bradshawgate, Bolton.

He appealed the conviction but lost, and an extra £1,000 was added to the costs.

But Hogan, 43, of Hollinshead Street, Chorley, has failed to pay the money and on Friday he appeared at Bolton Magistrates’ Court where he was sent to prison for six months.

His wife, Denise Hogan, who is the landlady at The Swan With Two Necks in Chorley, said after the hearing: “He has not hurt anyone or robbed a bank.

"I feel lost for words that he has been sent to prison for letting someone smoke a cigarette.

“I think that the courts are making an example of him and I am devastated.

“I believed in everything that he said, but he just went the wrong way about it.”

When the smoking ban was introduced in July, 2007, Hogan said he wanted to give people the freedom to choose.

When Bolton Council brought the prosecution he pleaded not guilty to five counts of failing to prevent people from smoking in his pubs and four of obstructing council officers.

District Judge Timothy Devas found him guilty of four charges of allowing people to smoke.

He was cleared of one count because he was not on the premises at the time, and he was found not guilty of four obstruction charges.

If a fine is not paid, court enforcement officers follow it up, and if it remains outstanding the case will be brought back to court for magistrates to give an alternative sentence.

The smoking ban is just another clear example of the Health fascists and new labour taking away peoples choice. this ban could have been introduced with consent, there is no reason why pubs, clubs etc could not have had a seperate smoking room. But the dictators wouldnt hear of it. Despite what the anti smoking campaigners say, it is the smoking ban that is causing the pubs and clubs to close. The non smokers said they would happily go back to the pubs. well where are you? sadly they dont accept that their campaign has destroyed a great british establishment, the pub. they say that pubs have diversified into food. well that to me is not a pub it is a resturaunt. these people are anti british and should be banned from our shores. this government is starting to realise the damage it has caused. at least 30 pubs per week are still closing. just look around your area. time is running out for these dictators.
Let people make their own mind up. it is called freedom.

This is just a classic example that not every one in our jail system is a Criminal. It does not matter who runs the country they all are as bad as one another Corrupt from the bottom down. They have the cheek to tell us we live in a society that says we have the freedom to express ourselves. If they call this democracy they can bend over and shove it where the Sun dont Shine.

Well done to the District judge. Keeping this filth called tobacco, away fom the public, saves lives and helps stop it`s spread to youngster`s. The ban is here to stay! So we can all breathe easy where ever we go.

Well Mr Hogan, the only place you can smpke in prison is in your own cell, any attempt to light up anywhere else in the establishment is likely to result in a prison officers' baton rammed right up your jacksie!

What a stupid idiotic waste or tax payers money. Why on earth are these lunatic judges jailing people for allowing consenting adults to smoke a cigarete. If they are short of people to lock up have a walk around any estate after dark, many in broad daylight on your own and you will soon find someone after they have assaulted you or even worse. This is indeed just one more reason to get rid of this hideous govenment who have destroyed the very soul of the good people in our society in order to please the few. They have created a society of snoopers and intollerance despite spouting off how they have done just the opposite. Give people back their freedom you may find they get it back by means that may not be pleasant. Wake up and prosecute the evil nasty people who deserve it instead of letting them off for fear of upsetting communities who thrive on evil and nasty ways. Leave the people alone who are practicing democracy. Nobody voted for this smoking ban, this is the workings a facist dictatorship in diguise of a democratic party (Do Not Forget The Vote On The European Treaty We Did Not get). Where are the antifacists now!!!! Oh dear they must be busy on some march or other representing the views of the majority, I think not!!!! Leave people to decide their own lives. If people do not like none smoking pubs open up some none smoking pubs. P.S i don't smoke but I do believe in freedom unlike some. This is ridiculous. An individual who breaks a law that conscience tells him is unjust, and who willingly accepts the penalty of imprisonment in order to arouse the conscience of the community over its injustice, is in reality expressing the highest respect for the law.

I have the highest respect for Mr Hogan - I have NO respect for spiteful or unjust laws.

When the real anti-social scum are allowed to walk our streets with impunity, it's an outrage that this man is having to serve a prison sentence.

The way things are going, prison is going to re a rufuge from the dregs on the outside and those running the 'justice' system.

Vote Labour for another five years of this nonsense. I despise everything that the Tories stand for but I'll be voting for them in May to try and get rid of Darwen's Labour MP.

I would sat that it's Mr Hogan who is a disgusting specimen of a human being. The man openly flouted the smoking ban and not only that but rubbed the officials' nose in it, what did he think would happen to him? Pat, can you imagine what state the country would be in if we all decided to pick and choose the laws we followed?

Well said Annon 7. truth is this ban was just brought in on a Whim to satisfy a few people who pretend to represent the majority view or think they konw best. I remember bullies when I went to school and I have met them at work. I am not about to accept what they say. Thats what we are up against. I reserve the right to decide what is right for me so long as I do not impose it on anyone else against their will. WE ALL WANT AND DESERVE CHOICE as human beings in a SO CALLED democracy. Lets elecrt someone who might just give it. Get rid of these IDIOTS.

PG Tips and Stupiddog probably members of the heaqlth club do gooders who venture to a pub once a year and spend a fiver and think they have paid a fortue. How about a law banning boring people with nothing better to do than criticise others. You can bet these two have vices which a lot of us smokers find irritating. I can think of one they write Bull $hit for instance.

plus you make it sound like you also have a drink problem, if you are always in the pub. buy yourself a thick coat so you can smoke outside the pub. at least my clothes dont stink anymore like your breath does.

No Denise! He went to prison for breaking the law. Whether you believe the law to be right or wrong is irrelevant. You can't pick and choose which bits you want to adhere to.

My Hogan was not jailed for allowing smoking in his pubs. He was jailed for not paying his fines. The system would seem - considering all this dates from a conviction in January 2008 - has tried every avenue to get Mr Hogan to cough up without being banged up.
That said the smoking ban has been another fiasco overseen by the Supreme Soviet that is the Brownist-Blairite leadership. Not one of their pieces of legislation has been without the additional law of unforseen (to them) consequencies. The number of pubs closing is nearer to 50 per week than the 30 quoted above. Granted not all will be due to the smoking ban, but it hasn't helped. Of course, the dept of health want you to stop smoking (it is good advice) but the treasuary, with great double standards is happy to rake off the tax from folks ciggies.

whilst we are on the subject of smoking i dont understand why people smoke, i watched my dad die of lung cancer,it left a normal size bloke into a weak, frail man in so much pain, death was a blessing, i also have his death certificate which states due to smoking.
so anyone who would like to give me stick for loathing smoking feel free.

Liebour and gordon brown has whittled away freedom of choice for people with his hitler type antismoking legislation;you can't do anything in this country without being frowned on or picked on from upon high. I don't smoke but I have friends and family who smoke and I believe in freedom of choice for them and that choice shouldn't be curtailed by the H&S pc dogooders.

Im an ex smoker and if there is one thing the government in our messed up country has got right it is the smoking ban !

I remember times when you could freely walk around town centre, clubs, pubs, restraurants, literally anywhere and puff till you huff without the care for people around you..

Now with my wife pregnant, it feels nice to be able to walk around smoke free town centre etc and not having to worry about second hand smoke..

You break the law then pay up or do time.. I dont mind my taxes funding you!

I would hate to live in a world some of your would seem to encourage.
I think it would overun by drunk, stoned, theiving, scum, and the rest of us would live in fear.
Why is it that because you are not allowed to smoke, those who brought it in are fascists, by the very nature of your comments you are the fascists here.
If you want to use this as a reason for clubs and pubs closing then go ahead, I think there are far too many anyway, so a good cull is in order.
As for those that are opposed to the ban, how very selfish of you, and yes, you smell !!

Its very rare I drink however when I do its more than a fiver spent you can be assured of that. This ban has costs people their jobs because of the likes of you and other health freaks. Now that youve got your ban I think its time a questionaire with the next census went out with the question are you a non smoker if the answers yes. Put up your Taxes for the lost revenue.

i think it is wrong the smoking ban! i have friends that say there annoyed that they have to come outside to have the conversation that we was having in the pub because majority of people smoke, my step mum who doesnt smoke said its rediculous and would happily have the old rules back. why cant they have signs in windows saying smoking/non-smoking pub or food/no food then i would have the choice and so would others, IF it wasnt for the PC BRIGADE many pubs wouldnt be shutting down BECAUSE ITS THE FREEDOM OF SPEECH AND ACTIONS.

NOBODY HAS ANY REGARD FOR NON SMOKERS CHOICE, IF THEY SAY ANYTHING ABOUT IT ITS FREEDOM OF CHOICE, SPEECH, HEALTH FREAKS.

Funny thing is, most of the non smokers go outside too, they join the smokers because smokers are social people.
