A MAN turned up at his brother’s home uninvited despite an order which prevented him having any contact with his sibling.

Blackburn magistrates heard Brian Lee Schofield rang the buzzer at his brother’s Burnley flat in the early hours of the morning and asked him for a fiver.

Schofield, 62, of Eagle Street, Accrington, pleaded guilty to breaching a non-molestation order in favour of Malcolm Schofield. He was fined £60 with £85 costs and £30 victim surcharge.

Philippa White, prosecuting, said Malcolm Schofield felt he had been harassed by his brother constantly asking for money and making threats.

“He felt it necessary to ask for a non-molestation order and that was put in place in November 2016 and then again in November 2017,” said Mrs White.

Mark Williams, defending, said it was the first breach of the order since 2016.

He said on the night of the latest incident Schofield had been visiting his sister in Nelson and set off to walk home because he didn’t have any money for transport.

“His brother lives in Burnley and he decided to go and ask if he would lend him a fiver for a taxi,” said Mr Williams.
