A 23-YEAR-OLD man who fell off a mini moto he was 'test-driving' at 11.30pm later gave a breathalyser reading more than four times the legal limit.

Blackburn magistrates heard Adam Jordan Bleasdale didn't know the small scale motorcycles were subject to road traffic regulations and he thought he was road testing a toy.

Bleasdale, 23, of Hodder Street, Accrington, pleaded guilty to driving with excess alcohol, while disqualified and without insurance.

He was sentenced to eight weeks in prison suspended for 12 months, given a 15 day rehabilitation activity requirement and six months alcohol treatment requirement and ordered to pay £85 costs and £80 victim surcharge.

Catherine Allan, prosecuting, said a witness was sat in her home on Bellfield Road at 11.30 pm when she heard what she described as a very loud lawnmower being driven up and down the street.

She looked out and saw the defendant riding a green mini moto.

"When she went to the door to complain she realised he had crashed and ended up giving him first aid to a head injury," said Miss Allan.

Bleasdale gave a roadside breathalyser reading of 141 against the legal limit of 35. He was taken to hospital and a later blood alcohol sample showed an alcohol level of 282 against the legal limit of 80.

Gareth Price, defending, said if it had been a deliberate decision to drive a car Bleasdale would have been in a far more serious situation.

"As he saw it was the purchase of a toy which he was effectively road testing," said Mr Price.
