A 36-YEAR-OLD man has been jailed for the second time for breaching an order put in place to protect his ex-partner.

Blackburn magistrates heard Paul Lomax’s mother Patricia went downstairs in the middle of the night and found him stumbling around in her back garden.

The court heard Lomax’s former partner lived at the address and he was prohibited from approaching her or the house.

Lomax, of Washington Street, Accrington, pleaded guilty to breaching a non-molestation order imposed by the family court in January. He was jailed for six weeks and ordered to pay a £180 criminal court charge and an £80 victim surcharge.

Catherine Allan, prosecuting, said Lomax had been jailed for three breaches of the order in March and made subject to community supervision for a further breach on November 18.

“This is the fifth breach of an order,” said Miss Allan.

Damian Pickup, defending, said on the day of the incident Lomax had collected his diazepam prescription, adding: “His mother is his carer despite him being banned from approaching her home because his ex-partner and their child live there.”
