Nelson schoolboy’s third attack on teacher

A SCHOOLBOY who attacked his teacher for a third time has been given a rehabilitation order after being told he was “at high risk” of more violence.

Burnley Youth Court was told how the 15 year old, from Nelson, kicked the teacher as a group of adults tried to get him to go into detention.

The teenager, who cannot be named for legal reasons, has already a conviction and a warning for assaul-ting the victim at his Burnley school.

The youth admitted assault by beating.

He was given a six-month youth rehabilitation order, with supervision and must pay £50 compensation to his victim.

Alex Mann, prosecuting, said in November 2010 the defendant was warned by the school for attacking the teacher.

In March last year, he was prosecuted for assaulting him and had to pay £100 compensation.

The defendant did not want to go into a room for detention, was kicking out and several staff members were trying to help.

The teacher was nearby, but was not getting involved.

The deputy head tried to get the boy to go into detention, but he refused. As he was being detained by other staff, the pupil kicked the teacher hard.

The court was told the teenager had already apologised to the victim and there had been no further trouble.

Catherine Fell, for the pupil, said at the time he and the teacher did not have a good relationship. The school had agreed to keep the pair separate.

The defendant did not think he had done anything to warrant detention and accepted he was aggressive to the other teachers, who were trying to calm him down.

The teacher went over, was on the periphery, and shouldn't have got involved. That made the schoolboy more angry and he kicked out.

The chairman said: “At the moment, you are at high risk of more violence.”

A school can impose a reasonable sanction - here, detention - if a pupil misbehaves. What is 'reasonable' is ultimately examined in court. Teachers can resort to restraint in order to prevent serious disruption, injury or damage to property. Again, what counts as 'restraint', 'serious disruption' and 'damage to property' is important here. Whose property?

By force, a pupil can be prevented from leaving a lesson (Department for Education, April 2011). By what force - electric force, manifested by the use of Taser weapons? By this device of language, the Department for Education does not exclude such use.

Should have been tasered till he p1ssed himself. Then birched, then salted and then tasered again. Bet he wouldn't re offend then.

Sorry, what this poor child, who comes from a broken home, needs is a holiday and free cinema tickets and lots of love and attention.
The Teachers at His school need re-training and were obviously too harsh on the poor child.
At dinner times He should be playing an Xbox and even missing lessons if He doesnt get the chance to complete His game.
All of the other comments should be ignored as they are from the dark ages.

If this had been a dog that had attacked someone, it would have been put down !!!!!!!

Yet so called "human beings" can act like animals and are treated and protected like they are the victims !!!!!!!

Agree with KDG but would go all the way and put "it" down, because this "thing" will only get worse as it grows older, because the "pc world body" in this Country sees it as the victim.

The reason this Country is in the state its in now, is because these "things" are left to do what they want without ANY discipline whatsoever, and the ONLY way for, IT and Society to progress for the better, is to put it down, simple cccccch !!!
