Padiham Tesco battle could cost council £250,000

A LEGAL battle over a controversial proposed supermarket in Padiham now has around £250,000 at stake, the Lancashire Telegraph can reveal.

Retail giants Tesco are fighting the refusal of planning permission for a new store on part of the former Baxi site, off Wyre Street, by Burnley council’s development control committee in March.

Lawyers representing the authority and supermarket chain will do battle at a four-day public inquiry in July over the issue.

An initial estimate of £100,000, to marshal the council’s case at the inquiry, was given by planning officials.

But a secret report to borough councillors has outlined that the overall bill could now reach £250,000.

This would cover the cost of hiring planning consultants and a barrister for the appeal and any potential award of costs by a planning inspector, if the council’s case was thrown out at its conclusion.

The store was turned down by councillors because of the impact it would have on fellow traders in Padiham town centre and the amount of traffic it would generate.

About 900 letters were sent in opposition to the blueprints by Padiham residents and traders, ahead of the March meeting.

Traders are considering their next move in response to the inquiry being called and are expected to take part in the hearing.

But not everyone in the market town is against the Tesco plans.

Town councillor Bob Clark said: “It is absolutely split down the middle regarding Tesco, depending on who you talk to.

“There are the traders who say that Tesco is going to have a major impact on their businesses, and there are a lot of empty shops. "But there are also people who would look forward to it coming to Padiham.”

traders beware.if this goes ahead it will put most of you out of buisness.full time jobs will be replaced with part time,and you will end up with rows of empty shops and takeaways.if you allow this you will lose the community that you know.these big supermarkets wont be happy until the have all the buisness,and they dont care who they hurt along the way.

Tesco V Padiham Residents .
Tesco Big Brother and costs to the council tax payers in these times of ciriss 250,000 Pounds . Tesco if you are so minded to provide a service to the people of Padiham and not intent on destrying the small buisnesses that form the backbone of this community in which you have allready two outlets in this small town
Why not do you stand the cost of any enquiry and listen to the people and traders in this small unique community. Is this shear gread ?.

Revealing the council's budget to Tesco's lawyers is quite a dumb move. There's a reason these reports are secret and I only hope that the story has got its facts wrong, otherwise Tesco now know exactly how far they can push it.

How to save £250,000 quid. Let Tesco build the store, and if the council is right, no-one will walk through the door and the store will close, and the council is vindicated. However if Tesco is right and the store is popular, Tesco wins. I know where I would place my bet.

You are quite right. £250,000 is nothing to Tesco, they can easily afford it (after all it's tax deductible).

The council on the other hand has very limited resources, this amount represents the council tax paid by around 200 households, if people don't want the store then they can vote with their feet.

It is any council's duty to decide on the strategy for their town. If the strategy is to maintain a town centre so that the town retains a community feeling rather than being a commuter housing estate then surely this is good? We have too many communities falling apart because people have no sense of belonging. Some of this has been caused by councils and their lack of vision and knowledge, allowing large out of town developments that decimate traditional shopping areas. I agree that once an application such as this has been turned down then companies such as Tesco should foot the whole bill for appeals, whther they win or lose. Their budget is immense whereas the local council has to justify their spending. Please don't take me as a Luddite as I welcome change and improvement but this should not be fueled by a huge corporation's ever increasing ambition to dominate the retail sector.

get tescos in town..good for all the town,more jobs,cheaper stuff,better opening times,NO HALF DAYS(WERE IN 2010 NOW)..and cheaper petrol,rip off texaco....there excuse for not wanting it was feeble(the traffic on the road),,,main gas,the yarn exchange,ray makers all used that road before now there all gone,no excuses...
