Injured boy's family vow to seek damages

THE father of a teenager who was injured by an alarm gun' has vowed to seek damages against the man who had the device fitted.

Jack John Ashley, known as JJ, will never regain the use of his left hand, which was maimed after he picked up a shotgun cartridge, fired from a makeshift security device at a mill in Worsthorne.

The cartridge, which was a live round instead of the blanks which were supposed to have been used, exploded in his hand, severing an artery and causing considerable blood loss.

Three men - mill owner Jack Clarkson and his friends Peter Smith and Derek Kokocinski - were cleared at Burnley Crown Court this week of firearms charges after a three-day trial in relation to the incident.

But JJ's father Phil, also from Worsthorne, has consulted a barrister over launching a private prosecution against Mr Clarkson, of Water Street, who runs Worsthorne Enviro Skips in nearby Gordon Street.

Mr Ashley said: "There are two things which are going to be happening now. First of all there is a Health and Safety Executive investigation.

"They could not proceed while the criminal inquiry was ongoing but I have reported the matter to them to take action.

"I am also going to be taking out a civil action against Mr Clarkson and have consulted a barrister. This will be on a charge on malicious wounding, and not on firearms charges."

The family was disappointed that wounding charges were not pursued by the Crown Prosecution Service initially over the incident.

Mr Ashley says that JJ, now 14 and a pupil at Bacup and Rawtenstall Grammar School, is fortunate that, due to the skill of surgeons, they were able to save his left hand.

But while the injury still allows the teenager use of his hand, it will never fully regain its mobility, as a result of the injury he sustained, he added.

Mr Clarkson has insisted that he installed the security device after suffering repeated break-ins and fires at the site.

The single-barrelled contraption was supplied to him by Mr Kokocinski and Mr Smith also had a similar device on his allotment.

The friends produced another similar device, which they said had been purchased recently, to prove how easily obtainable such contraptions are.

Mr Ashley, who says the devices are dangerous and unnecessary has petitioned Burnley MP Kitty Ussher to make such devices illegal.

He was a lad breaking into premises that he had no right to be on in the 1st place think yourself lucky it was his hand, had he gone through the roof he would probaly have died, I hope the courts see sense when dealing with this claim and award the Company compensation from the parents, breakin like these cost Companys thousand of pounds in loss work and production so any cost incurred on the Helath and Safety report I feel should be borne by the parents. if it was Mr Ashleys home that was repeatledy getting burgled wouldnt he do something about,your son should not have been there he was trespassing, to the Company did you have a trespassers will be prosecuted notices up, if so prosecute you will probaly have a cut and dried case.

I have been watching this story with interest. Maybe just maybe if the family started with teaching young JJ that you don't venture onto other people's property and also teach him a LITTLE respect this may never have happened. People are sick and tired of having to watch out for toerags like this and good on the guy for taking control of the situation, I just hope that taxpayers money is not wasted "looking after JJ" through all this

I hope that the owners of the factory now decide to sue the boys family for the damage that hes done, pity they cant sue him for loss of earning in court appearences, if the scumbag adnt broken in they wouldnt have been in court for his injuries, lets hope its his head next time, sounds like the all family are the same, a kid to a point is what you bring him up to be.

I honestly can't believe what I just read!

I think that the comments here say it all.

The family of this boy must question why their son gets in trouble.

Oh, of course, that's it! It HAS to be someone else's fault!

Look to yourselves and the way you are bringing your son up before you start blaming people that are simply trying to protect themselves from people like him!!!

A trainee thug and criminal in the making.

Perhaps rather than give their son a bad example and try to claim, claim, claim, the family of this boy should instill some DISCIPLINE in him!!!

Will that happen? Not a chance. Just one more imbecile that our politically correct society will have to carry through life whilst he burgles, beats up and bothers decent folk.

I cant believe what i have just read. Nowadays the families dont teach their children any respect. Whatever happened to this JJ, serves him right and i dont think he's gunna still learn, so it might have been better if he had been hurt a bit harder . JJ comes from a really bad background and his parents are to blame for this aswell. I just hope that "scrubbers " and so called "thugs " like this family have learnt a lesson.

He's consulted a barrister? How would he have instructed a barrister? A barrister is instructed by solicitors to advise on behalf of a client, not by a complainant direct.

Of course, the littl e darling WILL get some compensation. Without doubt.

His parents should be spending their energies instilling some discipline into their feral little monster, nstead of patting him on the head (there, there, what did that nasty man do to you?) and making him think he's done no wrong and that the world owes him a living.

This kid goes to a school where you have to pass an entrance exam.
So he should have had the brains NOT to trespass-a shame his injury is severe,but his 'parents' should not be blaming anybody but themselves for not controlling their son-He is still their responsibility,if I am not mistaken.

Will Mr Ashley also be petitioning the government for legislation to deal with the underclasses who think it's their God-given right to run roughshod over the rules and regulations, and do whatever they like to the law-abiding citizens of this land and their property? I expect not.

Kids like ths should be encouraged to handle fireworks and not to wear seatbelts, in my opinion. Get rid of the wasters.

How could the shell have "exploded in his hand" if he picked it up after it had been "fired from a makeshift security device". I'm no firearms expert, but my understanding is that a shotgun shell only goes bang once.

It sounds more likely that this dumb kid was in the process of dismantling the device when he set it off.

The boy's father is a disgrace. The boy broke into someone else's premises and now wants compensation for his own stupidity. The family should be paying the legal costs of the poor guys dragged into court because of this brat's actions. And why has he not been charged with criminal trespass?
Sadly typical of the irresponsible breed of parent that is becoming only to common these days.

how proud must his parents be!! tresspassing with most probably a view to commit burgalry or even arson!! if i was that kids parents i certainly wouldnt be giving any interviews to the press id be hanging my head in shame. just goes to show the level of eduction in that family! its a crying shame he didnt injure himself more that day, one less scumbag dole dosser for the future

Here we go again it always boils down to money, teach your kids to break the law and then sue for as much as you can get. No doubt the, no win no fee, parasites will be queuing up to take on this claim well I hope it costs them and the parents a packet.

What a farce. Ashleys parents have made him out to be an angel,how wrong they are. I'm only going off what I have been told about him but he's a menace.
Fully got what he deserved in my opinion.All this rubbish about him being an up and coming pianist is a load of rubbish.More like an up and coming PENIS!! Wake up and smell the coffee Ashleys parents,your son is a pain in the arse and you know it!!

Feel sorry for parents and the young lad involved,how can you get away with putting live weapons intent to cause harm out on display,what if a young kid had lost his ball and gone in to get the ball and it made real damage to them eve killing him or her would they have called them young thugs then,NO i dont think so and kids these days are kids who said they went in to rob someone,wern't we all young once ?

First of all the weapon wasn’t put there to harm anyone and Second of all the weapon you speak of isn’t a weapon unless a person uses it as a weapon, (“for example” a bottle, not a weapon unless someone uses it by smashing the bottle over the victim’s head) its an alarm gun used for signaling to warn the owners of the property, when trespassers have come on their land and to hopefully scare off the trespasser in the process knowing that someone knows they there,

If a young boy had gone into retrieve his ball the alarm gun wouldn’t had caused any harm, it might had made a noise if the boy had tripped it but that’s all. Damaged May happen when you pull these things out of the ground and start messing with them. And anyone thinking it was a bomb in the first place wouldn’t go near it in the first place if they had any sense. Child or no child

So your point is….? Are you retarded? Or can’t you be bothered to check out the facts or unable to read?

I do think some of the comments above are a little harsh as I wouldn’t wish harm upon anyone, but then again there’s a saying what goes around comes around, just a shame that JJ hasn’t learn anything in the pass 2 years since.

Who ever you are if you knew JJ and half the stuff he gets up to, you would be calling him a Thug too, unless you’re his parents close friends or family “possible” or the local press, otherwise you would think the sunshine shines out of his backside.
