Burnley restaurant bosses strip venue bare in rent row


POLICE were called after the outgoing tenants at an Indian restaurant stripped the venue of contents worth £100,000.

Abdul Muhith, the manager of the Ridoy restaurant and bar, Red Lees Road, Cliviger, said he had ‘done it Robin Hood style’.

He admitted stripping out items including fixtures, fittings, plug sockets, sinks, toilets, flooring and electrical appliances from the former Fighting Cocks pub at Mereclough.

Mr Muhith said he had bought the items at a cost of £100,000 and that his solicitor had said he was within his rights to take them.

Enterprise Inns, which owns the building, called police to the venue at 5pm on Wednesday.

Mr Muhith said a removal van was taking some of the items away at the time.

Police said on arrival they found the two parties engaged in a dispute.

But, after making inquiries, a spokesman said they were told it was a civil matter. No arrests were made.

Mr Muhith claimed a proposed rent increase was behind the decision to leave.

He claimed he paid £32,000 to Enterprise Inns for the existing fixtures and fittings in 2007.

But he said he removed them after taking control of the restaurant and put them in an upstairs room at the restaurant where he said they now remained.

According to Mr Muhith, a sum of around £100,000 was then invested to kit out the restaurant.

He said: “For two years I was telling them that we were struggling and that we needed help.

“Then when there was an increase in business they told us they were going to increase the rent from April.

“I told them it was hard enough to pay as it was and that I would have to shut if it increased. It was the last straw.

“I couldn’t afford to live like that. It was too much pressure.

“I took legal advice and my solicitor told me to take the stuff that I put in and leave it as I found it.

“We’ve done it Robin Hood style and taken it back.”

A customer said staff from the restaurant removed items including, sinks, toilets, light fittings, switches and plug sockets.

Every stainless steel item in the kitchen, including ‘splash-back’ panels and worktops, were ripped out.

Appliances such as dishwashers, fridges and ovens were also removed, he said.

Fire places, tables, chairs, fixed seating and carpets were removed from the restaurant and bar areas.

And decorative features which adorned the walls of the restaurant were also taken.

The customer said the building was now a ‘shell’ with wires hanging from the ceiling and just planks of wood to walk across.

Peter Smith, who lives next door to the restaurant, said Mr Muhith and his colleagues had been ‘good neighbours'.

Cliviger Coun David Heginbotham is urging Burnley Council to buy the building and raze it to the ground.

He said: “It’s a massive old building which isn’t in keeping with the area.

"They could put a couple of nice houses there.”

Enterprise Inns was asked for a detailed comment yesterday morning.

But by 5.30pm the firm said it was unable to provide a statement as no-one was available until today.

This restaurant was an excellent dining place, i have been to it on numerous occassions, its a shame that they could not stay open. Typical big business they always want more.

I guess another few people would have lost their jobs, why is the local and national governments not helping out small businesses? Its ok to bail out banks, but what about SME businesses, they are the lifeblood of this town.

So our great politicians are saying that this should be brought and demolished. How does that make sense? what about those people who lost their livelyhood? shall we do this to all businesses that are shut or go bust? From the recent decisions that are being made by Burnley Council, it seems to me that they are lacking leadership and vision. Moreover, they are wasting funding which as come into this town to help with the housing problem, this is sheer negligence and wasted opportunity to get things right in our town. Its easy to blame Brown and his government, but what are the local leaders doing with the money they are recieving! Shame on all of you in the Town Hall, maybe you could raze that to the ground, as its not serving its purpose.

Izanears I fail to see how your comment is of any relevance to this particular article?

I have dined in this restaurant on many an occasion with my family & often when we have visitors from Australia & Scandinavia, they were always a friendly bunch & the venue was smartly done, typical of the landlords to do this to the tenants. The tenants were well within their rights to do what they did & good on them, if the landlords want to be greedy then two can play that game.

Nice one to hear that Enterprise Inns have had one put over them. Their dictatorial attitude towards tenants is unbelievable. All they see is asset - capitalise it to maximum - doesn't matter if tenants can't manage to make a living we've always got another sucker round the corner. But now of course m'learned councillor has interjected. The building was there long before Councillor Hegginbotham, I suppose his true suggestion will be on the same lines as the Derby Inn at Gannow Top - take it over - let it become a wreck - then we can make a work of art to cover it up!! What about local sevice to the community and any peripheral jobs round it. Waken up councillor most people live in a real world and aware of todays problems not just after the throw away one line headline grabbers which is typical of today's politicians talk.

A sad loss, an excellent venue lost through the greed of t people who had no interest in brewing but have bought brewery property to make huge profits from hard working tenants. Councillor Birtwistle
may buy it, without, as usual, consulting the people of Burnley) so the BNP who once had two ward Councillors in Cliviger (out of the eight they had in Burnley) don't get their hands on the place...and demolish what was one of the old Massey's brewery's finest buildings.
Many have'nt forgotten or forgiven what he has done to the Derby Hotel
...come voting time.

what a shame the ridoy has been forced to close , once for a change a resteraunt that you could go back to again and again , the takeaway meals from the ridoy were the best in burnley and i didnt go anywhere else apart from the sharjan down passed whalley. the jale zule was superb . if the chef from the ridoy returns to burnley and reopens in a new place i would glady like to know .
well done with the fixtures and fittings etc , that will show the greedy landlords , i would have done the same and not given them even a sniff of a curry !!

Just shows how out of touch with reality Councillor Heginbotham is - the ex-Fighting **** was built in 1901 and is completely in keeping with the area. Perhaps the council should put a CPO on his house? Or that monstrostity at the top of Greencliffe Lane.

The problem now with the Fighting ****/Ridoy is who is going to open it. As anyone know, Public Houses are not the Flavour of the Month when it comes to getting someone to buy/lease them.
The situation with this one is who is going to refurbish it, which will costs 10`s of thousands of pounds.
I agree it is a loss, but what will be the solution.
It is easy to criticise me but all those who do, perhaps should put their hands in to their pockets and buy it, refurbish it and reopen it and run it themselves, and find out that to produce a profit in the licensing trade is damned near impossible. The high rents are a blow, but the recent commercial rate revaluation will kill off more Public Houses, due to a doubling of the valuation and substantial rates payable increase. Perhaps some critics do not know about this seriously added burden. The people of Cliviger now have another catastrophe in their midst, a desolate empty and wrecked property to match The Holme.
Unless something is done quickly, it will become an overgrown site with a gaunt mauseleum in the midst of quality homes and lovely surrounding area.
Mereclough is without doubt one of the most attractive areas in Burnley.
I do not want wish this building to be an eyesore, and if there is a better very realistic alternative, I will be pleased to know.

I cant believe that Ridoy has shut down...this was probably one of burnleys best eating out places.. Its not fair on the owner and the people who worked there...i have been there on many occasions...the staff, management, deco, food was exceptional...i hope that the landlard get a "taste" of what it feels like to be treated in this manner...I think what the tenent did was absolutley right..im sure he didnt invest all that money for a unconsiderate landlord to walk into a ready made business... Ridoy will always get my order for that wicked LAMB JALE ZULE...all the best..

How typical that when someone works hard to build a place up there is always someone ready to try and take more off them. The owners probably hoped that Abdul Muhith would just walk away leaving them to put in a new tenant and give them more money.
It's backfired on them and they will end up with less, GOOD!

The pub/restaurant has been empty for a matter of weeks and you want us hard pressed rate payers to further enrich the deep pockets of Enterprise Inns by buying up the place because you foresee the Four Horsemen of the Apocalypse galloping over Thieveley Pike.

Get a grip, FFS. It's an empty pub, not a Taliban recruitment agency.

I Just wish to inform you that it has only been empty for five days, but lets see how long it will be empty before vandals come along and help themselves to what is left.
The Coaching House on Glen View Road was only empty for a couple of weeks before they began to strip the roof.
The Holme in Cliviger was burned down years ago, and still is in its burned down condition, minus lots of stone that has been stolen.
The Gordon Lennox closed down and sold for development. Still empty after three years.

I sympathise with anyone who has to live near any large unoccupied building which might attract undesirables, but the answer isn't for the rate payers to buy up and demolish every pub that closes its doors.

If we did this, our rates would go through the roof or it would mean massive cuts in other areas of funding.

It's also an overreaction to suggest such a thing for a place that's only been empty for, as you say, five days.

This just seems a case of the brewery trying to bully it's tennants to pay higher rents or leave, with them reaping the benefit of the hard work of other people.

Mr. Muhith et al are well within their rights to retain possesions that they have paid for.

Shame on you Enterprise Inns.

Cllr. Hegginbotham - I would suggest that, seeing as the brewery virtually forced tennants, who were considered good neighbours off the premises, that you put it to them to sort this out.

as a former employee of the fighting ****s, it is a sad sight to see it in such a state. not that i think that Mr Muhith and the other people involved with ridoy have done the wrong thing. enterprise inns are the ones at fault and i have absolutely no sympathy for the situation they no find themselves in. in response to councillor heginbotham's comments, surely as councillor one of his priorities for his ward should be to promote business and enterprise within the community, rather than suggesting the best idea is for burnley council to buy the building, knock it down and build big fancy houses that people can't afford!

the answer for the pub would be for enterprise inns to sell it to someone who could run it and make a profit without having every penny squeezed out of them in extortionate rent. i work within the licensed trade in a privately run business and although things have been tougher than they were over the last 18 months, we still make a very healthy profit, and will continue to do so even after the commercial rate revaluation so if the right use for the pub is found it would be more than possible to run it as a profitable business. however i'm not sure if this is possible whilst it is still owned by enterprise.....

It is easy to criticise me haha it really is easy to laugh at morons like you .When are you and your brown envelope brigade going to start pulling down the factories on trafalgar etc or the other empty properties on the industrial istates .What a joke he is lol is he really a councillor ??? i suppose he lives there and is one of the nimby brigade.

I feel sorry for them. They were very pleasant people and served good food BUT they have also taken 6 of my paintings which were hanging on the walls and to which they had no right and which they should have returned to me. So Ridoy owner, if you are reading this I want my paintings back please. MY name and contact details are on the paintings.
