A 38-YEAR-OLD man who breached an ‘unwanted’ restraining order for the third time has been jailed for four months.

Blackburn magistrates heard Thomas Howard was found hiding in a back yard close to where his partner and mother of his four children lived.

She told police he had not been there despite a neighbour reporting a disturbance involving a male and a female.

When she opened the door, Emily Baron had a small cut to the bridge of her nose which she said she had sustained falling into a door.

Howard, of Sandon Street, Blackburn, pleaded guilty to breach of a restraining order and racially aggravated threatening behaviour towards a police officer.

Scott Ainge, prosecuting, said Miss Baron was very agitated when she answered the door and demanded to know why the police were there. She said Howard had not been at her home.

When he was arrested in an adjoining yard Howard accused a Muslim officer of being ‘Taliban’ and asked why he was working for ‘this’ establishment.

“They stitched you up for 9/11 and you are a disgrace to that beard,” he said.

Jonathan Taylor, defending, said Miss Baron had made it clear she did not want the restraining order and was making efforts through her own solicitor to have it removed.

“At the moment we have a situation where she doesn’t want the order and doesn’t believe she should be restricted by it,” said Mr Taylor.

“After his arrest he was taken through the house and his children were there. He didn’t believe that was necessary. He used hurtful words to the officer and he is genuinely sorry for that.”
