Blackburn driver booked again as he fought parking fine

A PENSIONER was given a parking ticket while town hall officials were photocopying his disabled badge to appeal against another ticket.

David Evans, 69, of French Road, Blackburn, was originally given a £35 parking ticket on Friday, despite checking with an on-duty traffic warden that he was allowed to park with a blue badge on Lord Street West in the town centre.

When he returned a short time later, Mr Evans found another traffic warden had put a ticket on his car.

Mr Evans, who has emphysema and struggles to walk, said: "I was mad, but thought It's okay, I'll just appeal it.' "I found out to do that you have to go to the town hall, so I went on Tuesday afternoon and parked in one of the disabled bays at the back."

Mr Evans had to take his blue badge for photocopying at the town hall to appeal.

When he returned to his car, he once again found a ticket on his windscreen, this time for failing to display a blue badge.

Mr Evans said: "I joked to the clerk at the town hall that it would be just my luck to have another when I walked out. I went back in afterwards with the new ticket and he couldn't believe it.

"I'm going to appeal the second one. It's ludicrous."

Helen Smith, spokesperson for Mobilise, an organisation representing the disabled drivers, said: "It's not uncommon for this kind of problem to occur."

Ruth Carter from Black-burn with Darwen Disabled Access Group, said: "We have heard of this problem before in Blackburn. You have to remember though that the traffic warden at the town hall wouldn't have known the reason why the badge wasn't being displayed."

Coun Alan Cottam, executive member for regeneration said:"Mr Evans was informed by one traffic warden that he could park on a single yellow line restriction. However, another traffic warden on patrol noticed that the clock had been displayed incorrectly.

"The clock should be set at time of arrival as states in the booklet issued with blue badges and he was correctly issued with a ticket on May 8.

"With regards to the second ticket that was issued on May 13, Mr Evans was chall-enging the previous ticket at Blackburn Town Hall during which time he had his blue badge with him in order to get a photocopy.

"Obviously, the warden would not have been aware this was the case and was right to issue the ticket because there was no blue badge on display. However, as Mr Evans was following council policy, the council was only too happy to cancel his ticket."

sorry i took it you ment me as i have had emphysema for 3 and a hafe years now but im not a sponger and i dont wish to put other ppl at risk by driveing as i sometimes pass out and so i dont drive again im sorry i got you wrong

why do so many people complain, dose it matter if you can't spell are get to park without paying , do you not reallise that when you have a good job earn plenty of money, you can afford to put your pound in the metor, but when you are disabled you don't have the choice . I use to earn a very good living until an accident left me in constant pain, without my car and the advantage of parking very close to places I couldnt have any normality in my life, maybe these moaning morons should spend a day in the life of a disabled person . I for one couldn't lift my leg high enough to get on a bus . and why should I give up driving because I am classed as disabled . we are not all incapable of driving a car . and Im sure most of the disabled people would trade there disability for a good well paid job . think about how lucky you are before you complain about someone who isn't . ps and may I APPOLOGISE for the deliberate spelling mistakes.

Use of disabled bays by non disabled blue badge holders is abused anyway. The amount of people you see parking in them who are obiously NOT disabled. Then walking off. a blatant misuse of the blue badge.

As for parking on Townmoore. The bays there are so small it's hard to park with room to get out of the car as it is. As with most of the bays in Blackburn.

Funny you should say this i watched and NONE disabled driver park a BLACK BMW X5 in a DISABLED space near Argos on townsmoor retail park. Not only did the driver park in the bay he partialy blocked off the DISABLED bay next to him. People should have some consideration to BLUE BADGE HOLDERS and not park in the disabled bays, its the same with parent and children spaces the amount of time ive seen people WITHOUT children park in these bays.

So to conclude, the disabled driver correctly got a ticket in the first case which therefore means the appeal should fail. The second case - he should have taken a photocopy of the badge prior to parking so therefore the appeal should fail on that as well :)
Why are there so many disabled parking spaces in carparks when all disabled users know they can park anywhere?

This reminds me of a story I heard when I was in the war. Apparently a UFO flew directly over Blackburn Town Hall on March 23 1933. I was amazed when I read this story that the same thing seems to have happened to someone else. I just had to post a comment. I don't really understand the interweb, but I think I've done the right thing.

If someone else was parked in that disabled bay without displaying a disabled badge im sure that he would of complained to the council for someone taking his spot and why are there no Parking attendents there to help - BLAH BLAH ETC ETC. So why when he parks their without his badge hould anything be different. He got a correct ticket. The town hall isnt the only place where the badge could of been photocopied.
People are always quick to jump when things happen to them, but he was in the wrong!!

For a guy who has emphysema and struggles to walk, yeah he seems fine to sit down on a road. It must have been a struggle to get up again.

Older drivers are a risk on the roads anyway, they havent got the reactions and sight they once had. I think they should all just use buses with their NOW CARD

What is the point of this story?

It was his fault that he got the ticket in the first place because he hadnt set up his blue badge correctly. And the warden was right to ticket the car a second time because there was no badge displayed, wardens are not psychic so are doing what they are employed to do. He got his ticket cancelled so whats all the moaning about?

OAPS again moaning like they always do, 1 day of fame because he got in the paper. woop!
