Murderer brothers must stay in jail until 2011

TWO brothers jailed for life for a brutal street murder will spend a total of 30 years behind bars before they have any hope of being freed.

Thomas Anthony Aspinall, 35, of Windermere Close, and his brother John Aspinall, 34, of Gloucester Road, along with Paul Smyth, 29, of Pendle Drive, all Blackburn, were convicted at Preston Crown Court of the July 1996 murder of Kevin Sudall, in Cicely Lane.

They were jailed for life on June 24 1997, after a two-week trial.

Mr Justice Flaux, after reviewing the cases at London's Royal Courts of Justice, set the tariffs on the Aspinall brothers' life sentences - the amount of time they must spend behind bars before they can apply for release on parole - at 15 years apiece.

The court heard that Mr Sudall, 22, of View Road, Darwen, was attacked in the early hours of July 6 1996 as he left what was then known as Club Euro, in Blackburn.

He died in the intensive care unit of Royal Preston Hospital later that day.

Just a fortnight before he would have celebrated his 23rd birthday.

Mr Sudall died during surgery to remove a blood clot from the surface of his brain.

The court heard that apparent bad feeling between two groups of youths had led to him being punched to the ground before his head was repeatedly kicked and stamped on as he lay motionless on the pavement.

One witness described Mr Sudall's head being struck as if someone was "stamping on a beetle".

Setting the tariffs on the two brothers, Mr Justice Flaux said of them both: "None of the (standard) aggravating features was present in this case.

"However, in my judgment, the very nature of this unprovoked and senseless attack on a complete stranger is in itself an aggravating feature.

"The only mitigating factors which would seem to be present in this case are a lack of premeditation and the absence of an intent to kill.

"As the trial judge rightly concluded, this was a sudden and cold-blooded attack, swiftly and brutally executed.

The applicants have shown no remorse."

He rejected both brothers' submissions that they had made "exceptional progress" since being locked away, and that their tariffs should be reduced for that reason.

When time spent on remand is taken into account, the decision means that both brothers will be able to apply for parole in the summer of 2011.

However, they will not be freed unless they can persuade the parole board that they no longer pose a danger to the public.

When, and if, released, they will remain subject to perpetual "life licence" and liable to be recalled to jail should they put "a foot wrong" again.

good news,but these guys need locking up for a lot longer.i knew these two in my youth.they were ruthless villians.drug selling,bullys.they went about with a bunch of cronies fighting week in week out.it was always someone smaller though,or a smaller group.but they would hit people for no reason and they were doing it for years.we dont want them any more.

You lot should be ashamed of yourselves. Have any of you stopped to even think how the families of all concerned are feeling??? The dead lads parents could probably do without the reminder before xmas and the lads who were involved also have families who committed no crime but have had to live a life sentence of finger pointing and name calling so consider the feelings of all involved before you start spouting your venom!!!!!!!!!!

exactly what I said.........your misinformed about everything if you think every person in prison was brought up badly..not everyone who commits crime is dragged up by bad families....and the point i was making was that you were blaming the lads families and they are just innocent bystanders caught in the headlights and its unfair to put that solely on their shoulders.ok.

This is a bad situation all round, a family are grieving the death of a much loved son, three other families have lost sons to life sentences. and for what for a night out,which ended up in a disaster. As the judge said no-one set out with the intention of killing this young man. these lads will have to deal with whats happened for the rest of their lives and at the moment they are paying for what they have been convicted of by serving 15 years in prison to some its not enough but in the eyes of the law it is. people have to answer for their own actions and the families are not always to blame. the only winner in this situation have been the legal representatives.

Cath you summed it up in a good manner and that is generally what I have been trying to say....I hope both families can be left alone to get on with their lives instead of the media dragging it all up for all of them at such an emotive time of year.

poor kevins mum doesnt have too worry anymore she died within 12 months of a broken heart she never got over it and kevins dad is the nicest bloke you could possibly meet dont think he needs all this raking up again whay a decent law abiding family rip kevin

I lived in darwen at the time this happened and moved away not long after yes templar you are right there are two sides to every story. Those lads from darwen as well as the lads from blackburn where ALL drug dealers...but some people seem to have forgotten that bit.. may i add that one or two of the lads from darwen had infact taken drugs themselves on the night in question again people have forgotten that also...they were not as innocent as they have been made out to be...however that does not justify what happened to the lad. but please stop making them out to be angels they weren't.

i knew them well,from daisyfield to whitebirk.through the raves to the self destruction that came after.drugs were around for a long long time.its all they knew.lsd,speed,ecsta
sy,usually crappy drugs too.
known thieves too.that night wasnt just one incident was it though,im sure there was baiting all round for some time before.both were selling drugs,but only one side had family in golf clubs or freemasons.the others should have been sent down too.sounds hard but if you want to be rough,then you should be prepared to be roughed.sh1t on your own doorstep

BLACKBURN EARLY NINETIES NOT QUITE UNDERSTANDING WHAT YOU ARE SAYING SORRY. HOWEVER YOU ARE RIGHT A COUPLE OF OTHER PEOPLE SHOULD HAVE BEEN SENT DOWN TOO THEY KNOW WHO THEY ARE. thats how much you know rover i think that you will find that on the night in question there were drugs used by the lads from darwen...obviously you haven't done your research properly.

if thats the case, how come there were no drugs found in his body when they conducted the autopsy?
either way the murderers took away a life, they deserve to spend the rest of theirs behind bars. They must be very big men to jump and stamp on a defenceless mans head and body while he's on the ground.
