Plagued by yobs, couple can’t block off footpath

A PENSIONER plagued by yobs using a footpath across his land has been told that he cannot block the path off, because it would be detrimental to the public.

Gary Thomas, 69, has had bricks thrown at his house, used condoms draped on his garden fence and bags of dog faeces left by his back gate by people using the shortcut from Preston Old Road on to the Kentmere Estate, Cherry Tree.

The retired British Aerospace foreman bought his house 25 years ago and discovered in his deeds that the thin track of land actually belonged to him.

At the time the ginnel was just a dirt track but had been fenced off from the house by the previous owner.

In later years it was paved by Blackburn with Darwen Council.

Mr Thomas said: "People use it as a short cut and don't cause any trouble, but youngsters started using it as an escape route from the main road and that's when the problems began.

"One night I counted 80 teenagers hanging around in the ginnel.

"They throw bricks at the cars then run down so they can't get caught.

"They hang out in the back alley getting up to all sorts. They vomit and urinate everywhere."

And nearby pathways are also suffering from similar behaviour.

Mr Thomas said that the anti-social behaviour had put a huge strain on him and his wife Norma, 65, who has fought breast cancer.

After he was nearly hit by a brick hurled into his back garden, Mr Thomas decided to get the path blocked off.

He said: "A planning officer told me it wouldn't be a problem because it was my land and I could just reclaim it as garden.

"Highways said they couldn't see the path on any maps.

"I submitted plans, with a porch on the side of the house so there was no way anyone could get down.

"But it was denied because it would be detrimental to public amenities as people would have to walk the long way round to get to the main road."

Councillor Alan Cottam, the executive member for regeneration at Blackburn with Darwen Council, said: "There is an issue if the area in question is a highway for public use.

"Mr Thomas is the registered owner but a claim has been made under the Wildlife & Countryside Act 1981 for it to be registered as a public footpath."

The only thing detrimental to the public is the youths that hang around in the evening - this brave bunch threaten an elderly lady and her daughter who run the local corner shop. - they steal sweets and cola whilst kicking the doors and throwing things at the window. The police have been told but cannot be there all the time. Cut off their escape route and make things difficult for them. They are a nuisance to all of us residents.

If I was Mr. Thomas I would go to Framar gunshop,buy an air rifle and pick off the little scumbags each time they pass through...'Human Rights'? Bah Humbug!

I would stop pussyfooting around and get the land sealed off. Its his land, if the council take him to court he will win.
If he doesnt destroy the footpath asap then the wildlife lot will probably win their claim to it. DO IT NOW.

Oh, typically that is much more important than looking out for decent human beings? What WAS I thinking it would be more important to stop these people being subjected to what amounts to monstrous behaviour from kids who show no respect for anyone, anything. Least of all their own surroundings.

Now, course, the rights of these 'kids' matter more than the safety and health of more mature people. Tell me, where did it go SO wrong in the UK where adults are living in fear of scumbags and the law protects them?

Yes, get it sealed off. You also have Human Rights same as the scum who make your life a misery. Not only that these people are assaulting you by making your health worse. And there are grounds I would think for that if it came to court action.

You shouldn't have to put up with this and it's all very well some clever so and so from the council saying:

What about the rights of the victim for a change???

Going back to the Framar reference. Now in this day and age I cannot say take a shotgun and blow the little bastards away; I mean, if this were America, they'd soon get out of the pathway if someone did that.

We have been too tolerant in the UK and this is the end result. People who should have rights don't get them and the ones who shouldn't DO.

Says a lot when the health of a human being is put at risk because of a simple wrangle over land. What do these people have to do get attention - die?

But Framar ... I'd opt for heat seeking missiles. Why? Because they can run but they can't hide from them!

Let's all go round THEIR homes and urinate in their living rooms and living areas. Oops, Human Rights folks! It's not PC to do that. But when is it PC to ALLOW them to do it others?

So, you go tell the council to screw themselves to wall and get it sealed off.

If they try to take your Human Rights away as a result of protecting yourself fight them tooth and nail!

Eye for an eye WOULD be ideal,but,let's face it:If I decided to **** on the livingroom floor of the local lowlife,I would be arrested for Indecent Exposure,Urinating In A Public Place and probably,Assault On A Scumbags' Carpet;No-win situation all round,really...
Now,if I took a large calibre shotgun and blew the little f**kers' face off,went home,drank a bottle of Scotch,then I could claim 'temporary insanity' due to 'intoxication poisoning'...

Can't there be a compromise? If the footpath is causing problems now, it should be blocked off. But perhaps not destroyed so in future it could be reopened, if the yob problem decreases?

What rubbish most of you are talking about. You don't even live near to or use the ginnel. The kids in Cherry Tree spend no more time hanging around the ginnel then they do anywhere else in Cherry Tree.

The truth is, there's nowhere for them to go. Other areas of town, ie Green Lane, Aqueduct, Oakenhurst, Feniscowles to name but a few have designated play areas for the kids to hang out. There's nowhere in Cherry Tree. They just walk around.

The mess that's talked about in the article is mainly caused by adults - the dog owners letting their dogs fowl the ginnel & also by throwing their dog scoop bags. The dog owner that throws his empty can of Kestral Super Strength around the ginnel EVERY night isn't helping the situation.

Also if you know the area you'd realise that another path runs down a steep hill to the ginnel & whenever it rains all the debris from the footpath runs into the ginnel. This is then swept up by a member of the public and thrown back up the footpath into a big pile - along with Mr Super Kestral's cans! The picture in the paper showed this pile of rubbish.

So it's not all the kids' fault. If Mr Thomas follows Hellboys suggestion perhaps he wants to vent his anger at Mr Super Kestral & the other dog owners. There's very little trouble around the ginnel - don't believe everything you read.

Don't get sucked in by this "I'm a pensioner" rubbish. It sounds like Mr Thomas is just trying to round up support for his wish to have a bigger garden.

I USE THAT PATH ON A DAILY BASIS AND I HAVE NEVER SEEN TROUBLE OR ANY YOUTHS AND BELIVE ME AS A MOTHER OF TWO TEENAGERS AND A STEP MUM TO ANOTHER I KNOW MOST OF THE KIDS AROUND HERE MOST OF THE PARENTS ARE GOOD PARENTS WHO TELL THERE KIDS NOT TO ANNOY PEOPLE OR CAUSE TROUBLE BUT LETS FACE IT KIDS WILL BE KIDS WE ALL PLAYED OUT WHEN WE WERE GROWING UP!!!! ALSO IS IT RIGHT FOR THIS GENTLEMAN TO BE FILMING THE AREA THAT DOSNT BELONG TO HIM ,HE HAS FILMED MY SCHOOL GIRL DAUGHTER MAKING HER WAY TO HER SCHOOL BUS WITH OUT MY CONSENT OR HERS SOME PEOPLE MAY HAVE A NOTHER NAME FOR THAT KIND OF BEHVIOUR IE CHILD **** HE BETTER BE VERY CAREFUL HOW HE POLICES HIS PROPERTY I FOR ONE AM NOT IMPRESSED
