A MAN found at the home of his ex-partner in breach of a restraining order was allowed to go on his way after giving police false details.

Blackburn magistrates heard the female involved then told police who he really was and Harry O’Neill was arrested.

O’Neill, 41, of Clarendon Road, Blackburn, pleaded guilty to breach of a restraining order and also obstructing a police officer during the execution of his duty.

He was sentenced to 12 weeks in custody suspended for 12 months, ordered to do 20 days rehabilitation activity and pay £85 costs and £85 victim surcharge.

District Judge James Clarke said the prison sentence had only been suspended because Vivien Greaves had invited him into her home. He said O’Neill had been sent to prison for a previous assault on Miss Greaves and he had to realise that court orders were serious matters.

Ian Huggan, defending, said O’Neill had been at the address with the consent of Miss Greaves but accepted he should not have gone anywhere near.

“He is the one who is subject to the restraining order and he must make sure he complies with it,” said Mr Huggan.
